The rules of the road for using Cogenti fairly, safely, and confidently.

Please read carefully. These Terms form a binding agreement between you and Cogenti. They cover acceptable use, AI limitations, your data, and our responsibilities. If anything is unclear, contact us before using the Service.

Introduction

These Terms and Conditions ("Terms") govern your access to and use of Cogenti ("Cogenti", "we", "us", or "our"), including our website, conversational learning features, progress tracking, and any related services (collectively, the "Service"). By creating an account, starting a conversation, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Cogenti. If you are under 18, you represent that you have permission from a parent or legal guardian. You must provide accurate registration information and keep your account details up to date.

The Service

Cogenti provides AI-powered language learning through immersive conversations, structured courses, vocabulary tracking, and related educational features. We may add, modify, or remove features at any time. We do not guarantee uninterrupted availability and may perform maintenance that temporarily limits access.

Accounts and security

You are responsible for all activity under your account and for maintaining access to the email address associated with it. Magic login links are single-use and time-limited. Notify us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.

Acceptable use

You agree to use Cogenti only for lawful language learning purposes. You must not: attempt to bypass safety filters or prompt the AI to produce harmful, illegal, or sexually explicit content; scrape, harvest, or reverse-engineer the Service at scale; interfere with other users or our infrastructure; misrepresent your identity; or use the Service to develop competing models without our written consent.

AI-generated content

Tutor responses are generated by artificial intelligence and may contain errors, outdated information, or culturally incomplete guidance. Cogenti is an educational tool — not a substitute for professional, legal, medical, or financial advice. You use AI outputs at your own discretion.

Your content

You retain ownership of the messages and voice input you provide. You grant us a licence to store, process, and use that content to operate the Service, personalise your learning experience, improve our models and features, and ensure safety. Do not submit content you do not have the right to share.

Intellectual property

Cogenti, its branding, software, course structures, and underlying technology are owned by us or our licensors. These Terms do not grant you any rights to our trademarks, code, or proprietary materials except as needed to use the Service as intended.

Privacy

Our handling of personal data is described in our Privacy Policy at /privacy. By using the Service you acknowledge that we process account information, conversation transcripts, usage analytics, and technical logs as necessary to provide and improve Cogenti. Minimise sensitive personal data in conversations.

Third-party services

The Service may integrate third-party providers (for example speech recognition, AI inference, or email delivery). Your use of those components may be subject to additional terms imposed by those providers. We are not responsible for third-party services outside our reasonable control.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, that learning outcomes will meet your expectations, or that AI responses will always be accurate.

Limitation of liability

To the fullest extent permitted by law, Cogenti and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim, or €100 if you have not paid anything.

Indemnification

You agree to indemnify and hold harmless Cogenti from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your infringement of any third-party rights.

Changes to the Service and Terms

We may update these Terms from time to time. When we make material changes, we will post the revised Terms with an updated date. Continued use after changes take effect constitutes acceptance. If you disagree with updated Terms, stop using the Service.

Termination

You may stop using Cogenti at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will remain in effect.

Governing law

These Terms are governed by the laws of Ireland, without regard to conflict-of-law principles. Courts in Ireland shall have exclusive jurisdiction over disputes arising from these Terms, except where mandatory consumer protection laws in your country of residence provide otherwise.
